The Judicial Complaints Tribunal, established under the District Court Act 2018, is to investigate complaints made against magistrates and any other judicial officers designated by the Chief Justice.
Composition of Tribunal
Whenever required, the Chief Justice shall appoint as the Judicial Complaints Tribunal a person who has at least ten years’ legal practice experience.
Functions and Powers of Tribunal
The primary function of this Tribunal is to independently investigate allegations of misconduct against judicial officers, determine the merits of the allegations, and uphold the integrity of the justice system. Following its investigation, the Tribunal shall submit its findings and recommendations to the Chief Justice.
The Chief Justice is empowered to make rules governing the Tribunal’s jurisdiction, powers, practice, and procedures. These rules will provide an opportunity for a complaint against a judicial officer to be lodged and heard through a fair hearing process observing the rules of natural justice.
Complaints
It is important to note that the Tribunal cannot review, overturn, or challenge a judicial officer’s decision in a case. The appropriate avenue for challenging a decision in a case is by filing an appeal to the Supreme Court or Court of Appeal.
